2. Scope

 

These General Terms and Conditions of Sale apply to any contract concluded between Kintsugi Art and a consumer or professional located in the European Union or abroad, via the website www.kintsugi.art.

 

They apply to the sale of handcrafted products (e.g. urushi lacquer) and training services in traditional urushi kintsugi.

 

 

3. Pre-contractual information

 

In accordance with EU Directive 2011/83, the customer receives the following prior to purchase:

 

  • Key product/service characteristics

  • Total price including taxes (VAT exempt – Article 293 B, French Tax Code)

  • Delivery and payment methods

  • Right of withdrawal and warranty terms

  • Seller’s identity and contact information

 

 

4. Order and Acceptance

 

Orders are placed online via the website.

The order becomes binding upon confirmation by email and full payment.

By clicking “Place order” or similar, the customer agrees to pay and accept these terms.

 

 

5. Prices and Payment

 

All prices are in euros (€).

VAT not applicable (micro-enterprise – Article 293 B CGI).

Accepted payment methods:

 

  • Credit card (via secure processor)

  • PayPal

  • Bank transfer (on request)

 

Orders are shipped only after full payment is received.

 

 

6. Delivery

 

Delivery is available to all EU countries and internationally.

Estimated delivery times depend on the destination.

Shipping fees are clearly shown before final order confirmation.

Goods are shipped at the seller’s risk until handed to the customer.

 

 

7. Right of Withdrawal

 

In accordance with EU Directive 2011/83, customers have a 14-day right of withdrawal from the date of delivery or contract conclusion for services.

 

Exceptions:

 

  • Training already started (Art. L221-28, French Consumer Code)

  • Customized or made-to-order items

 

To exercise the right, email info@kintsugi.art.

Return shipping costs are borne by the customer.

Refunds are issued within 14 days of receiving the returned goods.

 

 

8. Training Services

 

Training courses are considered service contracts.

Registration is confirmed upon payment.

Cancellation is allowed up to 7 days before the start date.

After this period, no refund is available unless the session is canceled by Kintsugi Art.

 

 

9. Legal Guarantees

 

Products are covered by:

 

  • The legal guarantee of conformity (Directive 1999/44/EC or Regulation EU 2019/771)

  • The guarantee against hidden defects (Art. 1641, French Civil Code)

 

In the event of a defect, the customer is entitled to repair, replacement, or refund.

 

 

10. Liability

 

Kintsugi Art cannot be held liable for contract non-performance due to force majeure or customer fault.

Liability is limited to the order amount.

 

 

11. Personal Data

 

Personal data is processed in accordance with Regulation (EU) 2016/679 (GDPR).

Purpose: order processing, invoicing, customer service.

No data is transferred to third parties for commercial use.

 

Customer rights: access, rectification, erasure, restriction, objection, portability.

14. Applicable Law and Dispute Resolution

 

This contract is governed by French and EU law.

In case of dispute, an amicable resolution will be sought.

 

Pursuant to Regulation (EU) 524/2013, you may use the Online Dispute Resolution (ODR) platform:

Failing an amicable resolution, competent French courts shall have exclusive jurisdiction.
